Terms and Conditions Governing Domain Registration (Nominet)

Nominet Terms and Conditions Terms and Conditions Governing 99 Hosting v. 1.16 These are the Terms and Conditions of 99 Hosting. Please ensure that you read the Terms and Conditions as you are bound by these whilst using the 99 Hosting service.

1) The service that we are providing.

When we have processed your order form and received any fees, which are due from you, we will grant you a right to use the appropriate service i.e. mail forwarding, web hosting, domain name registration etc as detailed on our current price list ("the Service"). The right to use the Service is personal to you & will continue until our agreement with you comes to an end.

2) Who can use the service.

The Service allows only one person to access the service and only one connection may be made at any time using your user name and password. Please note that a connection from a computer network is not a single connection when more than one user will access the Service, and is therefore a breach of the conditions. You can share use of the Service with members of your family or business provided that only one person is connected to the service at any give time.

3) Passwords and Security

In order to use the Service you will be given a password and a user name. It is important that you keep these secret. We will change your password if you request us to do so or if we think that another person is using it.

4) Fees and charges.

All fees must be paid in advance of the period of use. The amount payable by you and the payment intervals will be set out on your order form or service connection request. We accept payment by credit card, debit card, charge card or cheque. If you choose to pay by credit, charge or debit card we will debit your card when your payments fall due without further reference to you. We may charge interest on overdue payments at an annual rate of interest equal to the base lending rate of Barclays Bank PLC plus 4%.

5) Termination.

You may terminate your agreement with us at any time by giving us notice in writing or e-mail. We will send you an acknowledgement of termination. Termination of the agreement will become effective at the end of the then current payment period provided that we have acknowledged your notice of termination at least seven days before the end of the payment period. We will acknowledge your communications within 48 hours of receipt. If you receive our acknowledgement less than seven days before the end of that payment period then the agreement will terminate at the end of the next payment period. We may terminate (or if relevant suspend) your access to the Service: -

(a) With 7 days notice in writing or by e-mail if any payment is due to us is 7 days or more overdue.

(b) At any time with 7 days notice in writing or by e-mail, in such circumstances we will refund any part of any fee that you have paid in respect of any part of period falling after that date on which we terminate your access.

(c) At any time and with immediate effect (without refund) if you abuse or use the Service for illegal purposes or if you deliberately breach our AUPS.

6) Acceptance Use Policies.

You are expected to adhere to our published Acceptable Use Policies ("AUPs"). The AUPs comprise common sense guidelines for use of the Service and change from time to time. The AUPs are designed for your protection and to ensure that others may freely enjoy the Internet. We are not in a position to monitor how you use the Service and accordingly (in the absence of us have been negligent) you agree to indemnify us against any claim that is brought against us or any reasonable costs or liability which we incur as a result of your use of the Service and we accept no responsibility for any action brought against you arising from your use of the service.

7) What you can expect from us.

We will do our best to maintain the operation of the Service. However we do not accept any responsibility for the computer equipment, dial up account or telephone services which you use to access the Service. In the event that the Service is unavailable for a continuous period of more than 30 days due to circumstances beyond our control you are entitled to terminate your agreement with us and to obtain a refund for the period it was unavailable. We are not responsible for maintaining any site or address other than our own and cannot guarantee the continued availability of any other person's site or address. In the event of default by us, whether this be for breach of contract, negligence or otherwise, in respect of any defect in or discontinuance of the Service our liability is limited to situations where we are at fault and the loss that you suffer is reasonably foreseeable. In those particular circumstances our liability is limited to the amount paid by you for the service proportionate to the length of the remaining agreement. We are not liable to you for any losses, which you suffer as a result of making or receiving payments by credit card through the Internet or as a result of using the Services for business purposes.

8) Personal Data

We may retain information that you give to us about yourself and use it to offer you other services provided by us and/or other companies. If you do not wish us to use your personal data in this way please notify us by post. Any information held by us about you will available for inspection by you in accordance with the terms of the Data Protection Act 1984.

9) Changes, Amendments and Notices

If we change the price of the Services or any of these terms & conditions we will give you at least 30 days notice. Such notice will be made by post, facsimile, e-mail or by advertisement on our main WWW page.

10) Governing Law & Jurisdiction.

These terms & conditions are governed by English law & we both agree to submit to the non exclusive jurisdiction of the English Courts.

11) Contacting the Web Site

If you have feedback with regards to any abuse, such as Phishing, Spam or Malware associated to your domain through a service provided by 99 Hosting, please choose the Abuse option in the contact form on the front page.

If you have a complaint regarding a service provided by 99 Hosting, please choose the Complaints option in the contact form on the front page.

Under all circumstances, 99 Hosting will respond professionally and timely upon receipt of your feedback, with a guaranteed response within 5 days.

12) We will let you know 90 days in advance of the expiry of a .uk domain before we send an expiry notice to you.

We will make you aware of our key terms, which include:
- What we charge for the domain-name related services (We will provide these costs at time of requested quotation in writing via email or letter).
- Our cancellation policy and how we deal with expired and expiring domain name registrations (This will also be in that email or letter).
- How you can renew a domain name. (We will contact you before your domain name expires informing you of the various payment options).
- We do not make a charge to our customers who transfer their domain names to a new Registrar, or is otherwise terminating their contract with us (unless any amounts are still outstanding).
